Malibu Ken Starr is a Crook
And... We're Asking Janet Reno to Indict Him
TUESDAY FEBRUARY 17th 1998 -- NEW YORK-- Here is a copy of our letter to Attorney General Janet Reno, who seems to be spending more time appointing special prosecutors against White House cabinet secretaries than she is indicting the likes of Haley Barbour, Newt Gingrich and a host of other felonious ultra right Republicans who disgrace the legacy of the GOP as well as sit fat and pretty in their taxpayer funded oak-paneled offices -- laughing all the way.
The Attorney General Of the United States
The Honorable Janet Reno
The Justice Department Washington, DC
Dear General Reno:
We are writing to request that you remove and indict Kenneth Starr.
This publication has been intently following the odious activities of Kenneth Starr. Recently Judge Starr has exhibited an almost total lack of control over his office, not only in the scope of its inquiry, but in what appears to be a never-ending attack on fundamental freedoms guaranteed under our Constitution.
While we agree with you that the independent council statute was a hastily assembled travesty, we also feel there must be some way by which you can intervene and halt what we have come to feel could be the destruction of this democracy. These are strong words, but we urge you to take them seriously, and to do your duty as chief law enforcement officer of the nation.
It is time to retire Kenneth Starr and request the three-judge panel to name a new and non-partisan independent council to pick up the pieces, reassemble the cases, if any, against the Clintons and get on with the show.
Despite recent appearances by well-respected jurists and associates of Mr. Starr, it is clear that the nation has lost trust in his ability to maintain his objectivity in all Clinton matters. Mr. Starr is a well known and active member of the Republican Party and has publicly mentioned running for public office under the GOP banner. Mr. Starr, whose investigations have resulted in indictments of only a few of President Clinton's associates, appear to have uncovered not a scintilla of evidence of wrongdoing, mis- or malfeasance, not to mention criminal activity, on the part of the President nor the First Lady.
Viewed from any perspective, Mr. Starr has constantly, and with malice, widened the scope of his "investigation" beyond that which is defensible and in doing so has undermined the spirit of Congress' Independent Prosecutor statutes designed to guarantee the comfort of the American people that investigations against covered people are carried out in the most hermetic manner.
You are certainly aware the IC statutes themselves were a knee-jerk reaction to the firing of independent council Archibald Cox and the resignation of two Attorneys General during the Nixon presidency. The Congress, although not careful in its design of the enabling legislation, made clear its legislative intent that "independent" council should be just that.
Mr. Starr has bastardized the process to such an extent that we find the American judicial system itself on the block. Can it be that this man can continue to dig for dirt on the highest office in the Land, unfettered by budget constraints, unchecked by you, unleashed by political foes of the President and the Democratic Party?
We think not.
What started with an investigation of Whitewater has now dissolved into a witch hunt on the private sexual life of a President of the United States. What began as a rational investigation has now transmuted into raunchy soap opera, complete with an almost total meltdown of the press -- once consider the fourth arm of government and an additional non-codified check on insanity that sometimes rears its head as "human nature."
Judge Starr was once a respected jurist - a man trusted even by elected officials on both sides of the aisle. Now, after years of inconsequential mining, Starr has lost control of his staff, himself and his mission. He is drowning in a sea of controversy and taking the nation down with him.
It is time he was stopped.
Mr. Starr's most recent foray into the sex life of William Jefferson Clinton is beyond rationalization. His cooperation with the team of gay-bashing Christian Coalition funded "lawyers" in a civil suit in unheard of in history. His move to take a chair at Pepperdine University -- funded by the ultra-right, and some say loony, Mr. Richard Mellon Scaife -- is an embarrassment, at least. His membership and outspokenness in such associations as the Federalist Society is more than enough proof of his partisanship and the underlying reason for what appears almost insane pursuit of the President.
Mr. Starr himself is reported to have admitted he will seek no prosecution of President Clinton for perjury or subornation of perjury and merely seeks to present the results of his "investigation" to the Congress for its consideration.
Really? Is his mission, therefore, political and not judicial in complexion? Is this not fundamental and foundational reason to dismiss him from his position post- haste?
The distribution of information by Mr. Starr's office is so broad as to be violative of the law. Not only are these leaks constant, planned and timed for best impact from the right wing point of view, but they are covert and inaccurate most of the time. These leaks violate Rule 6 (e) of the Federal Rules of Criminal Procedure and are unethical at best -- criminal at worst.
In short, Mr. Starr is making a mockery of the law. For years, members of the Clinton defense team have secretly urged Starr to stop the leaking by his associates and himself. These pleas fall on deaf ears. Now Starr is selectively releasing information which is false, pressuring witnesses, manipulating witnesses and intimidating witnesses in a manner unheard of since the fall of Hitler.
Mr. Starr has also employed spin doctors on his staff to manipulate public opinion to his favor and to injure the President politically.
He is contemptible and in contempt.
With the Monica Lewinsky investigation he has fallen into an abyss of criminal conduct for which he might face prosecution himself. He has participated in the illegal wiretap of Ms. Lewinsky. He has approved, without judicial or congressional oversight, the wiring of Ms. Lewinsky's "friend" Linda Tripp -- a known sociopath -- again without obtaining the requisite court order. He has leaked the tape recordings made of the fruit therefrom. He has engaged in the distribution of secret Grand Jury testimony to members of the press -- including the New York Times, and this information has been false, or half true depending on which leak one examines.
Mr. Starr had a sworn duty to stop these leaks and yet he has continued, for at least four years, to disseminate true or false information in an effort to politically cripple the White House -- not to bring any true or honest indictment.
Proof of our allegations exist wherever one turns. NBC and the New York Times both make reference to their sources as "members" of the Independent Prosecutor team. NBC, ABC, FOX, and CBS have all reported false stories tied to leaks from Mr. Starr's office -- purposeful leaks, designed and timed to have the greatest negative impact on the Clinton's and the Presidency.
The Wall Street Journal brazenly reported the Grand Jury testimony of a White House Steward - Mr. Nelvis, given them almost assuredly by members of Mr. Starr's "team." The Wall Street Journal, most often unfriendly to the White House, has also had to retract other stories based on leaked information from Mr. Starr's office.
The New York Times reported testimony from the President's personal secretary, Ms. Betty Currie, which was a complete falsehood. Yet the Times, THE venerable news source in this country, reported these lies as truth.
This could only have happened if their source was Mr. Starr's office.
Mr. Kendall, the President's counsel, has pointed our dozens of other Starr-sourced reports in the media, underscoring the fact that Mr. Starr is engaged in a witch hunt, not a prosecutorial chore to which he was entrusted by the People.
Starr's activities are illegal - plain and simple - under the law and the American Bar Association Standards for Criminal Justice.
He should be dismissed and simultaneously indicted by your office along with colleague attorneys, investigators and staff involved and suspected guilty.
If it takes a special prosecutor to investigate Mr. Starr, then appoint one.
If not, then indict him yourself.
General Reno, this publication has championed you and your wisdom for years to its 3 million readers. Now, we must ask you to examine your conscience - free from political constraint offered from both the Right and the Left. We know you are in the midst a political firestorm. But, you can rise from this fire and do, simply, the right thing.
On a less legal note, and we are certainly not scholars of the criminal law, we would like you to think about the innocents involved here. What about Chelsea Clinton, someone you are familiar with? Do you think she deserves to have her family's private and unproved dirty laundry hung out on the Justice Department lawn for her less-than-mature classmates to take up against her? Do you think Monica Lewinsky's mother, or members of the Secret Service deserve to be raked over the frenzied, money-fueled coals of the mainstream media ad infinitem? And how are the dozens of other family members, friends and colleagues of the President who rely on their jobs, their futures and their ability to make a living going to recover from these politically driven smears?
This man, Kenneth Starr, is clearly and unequivocally out to destroy all of them. He seems to have no sense of honor, nor the courage to step away in humiliation, as he should.
The issue has absorbed the man.
It is time to stop it.
We think you have more than enough evidence to remove and prosecute Mr. Starr.
If you cannot, for some inexplicable reason, then tell us -- What can we do, as concerned citizens, to swear out a criminal complaint against Mr. Starr and those around him involved in this indecency?
What can we do as average Americans to remove him from these cases?
We await your reply.
BEST REGARDS
